A brief history of online gambling in Canada

The Kahnawake Gaming Commission, which operates under treaty rights from the Mohawk Council of Kahnawake near Montreal, was one of the world's first online gambling regulators, established in 1996. Throughout the late 1990s and 2000s, Kahnawake-licensed operators served players from Canadian territory, while provinces ran physical casinos. The federal Criminal Code already gave provinces power over gaming, but how to apply that to the online world remained the big question.

The era of provincial monopolies really started in 2004 with the launch of BCLC's PlayNow.com, the first provincial online gambling site in North America. Other provinces slowly followed: Loto-Québec's EspaceJeux launched in 2010, the Atlantic Lottery Corporation followed shortly after, Manitoba joined the BCLC platform, and Play Alberta launched in 2020. Each of these was a single legal operator per province with no competition.

A major shift happened in April 2022 when Ontario launched iGaming Ontario as an open, competitive market. It was the only Canadian province to do this at the time. Now, multiple operators - both international brands and Canadian companies - could apply for an iGO contract, operate under AGCO oversight, and compete for players. Within 18 months, Ontario became the largest regulated online gambling market in Canada by handle, even though it only has about 40% of the country's population. Since 2022, provinces have moved in different directions. Ontario and Alberta use an open-market model, while other provinces stick to monopolies. For now, players in monopoly provinces who want more choice often use offshore-licensed operators. This remains a legal grey area; federal law targets unlicensed operators, not individual players.

Is online gambling legal in Canada?

Yes, but the setup is complicated. The federal Criminal Code, specifically section 207, makes most gambling illegal federally but provides an exception for provinces. This means each province can license and operate gaming within its own borders. There is no single national regulator; instead, we have ten provincial frameworks and three territorial ones, all working independently.

The practical answer depends on where you live. In Ontario, there is a fully regulated competitive market through iGaming Ontario (covered in depth in our Ontario casino guide). In other provinces, residents have one official provincial operator, such as PlayNow in BC and Manitoba, EspaceJeux in Quebec, ALC in the Atlantic provinces, Play Alberta in Alberta, or SaskGaming in Saskatchewan. You can also access the offshore grey market. While playing at offshore sites isn't prosecuted for individual recreational players, those operators do not have Canadian regulatory protection.

The main risk with offshore sites is consumer protection, not legality. If you have a dispute with an offshore casino, Canadian regulators cannot help. You have to resolve complaints through the offshore licensing body, such as the Malta Gaming Authority (MGA), the UK Gambling Commission (UKGC), or the Kahnawake Gaming Commission. Some regulators handle complaints well, but others offer little help.
