The Kahnawake Gaming Commission, which operates under treaty rights from the Mohawk Council of Kahnawake near Montreal, was one of the world's first online gambling regulators, established in 1996. The federal Criminal Code already gave provinces power over gaming, but how to apply that to the online world remained the big question.

A major shift happened in April 2022 when Ontario launched iGaming Ontario as an open, competitive market. It was the only Canadian province to do this at the time. Now, multiple operators - both international brands and Canadian companies - could apply for an iGO contract, operate under AGCO oversight, and compete for players. Within 18 months, Ontario became the largest regulated online gambling market in Canada by handle, even though it only has about 40% of the country's population. Since 2022, provinces have moved in different directions. Ontario and Alberta use an open-market model, while other provinces stick to monopolies. For now, players in monopoly provinces who want more choice often use offshore-licensed operators. This remains a legal grey area; federal law targets unlicensed operators, not individual players.
Is online gambling legal in Canada?
Yes, but the setup is complicated. The federal Criminal Code, specifically section 207, makes most gambling illegal federally but provides an exception for provinces.
