Real-money online gaming is now banned across India under the Promotion and Regulation of Online Gaming Act 2025, passed on 22 August 2025. From the 1867 colonial statute to the 2025 federal ban

The original law for gambling in India was written in 1867, long before the internet, so the Public Gambling Act 1867 never mentioned online play. Over time the Constitution left gambling to the states, and the result was a patchwork: a few states such as Sikkim and Nagaland set up their own online licences, some states banned online play outright, and most simply relied on the old 1867 statute. Alongside this, courts spent decades drawing a line between "games of skill" and "games of chance", which is how rummy and poker came to be treated more leniently than casino games.

In 2023 the central government tried to bring order to online gaming with a Self-Regulatory Body framework under amended IT Rules, but that framework was never operationalised and the industry kept running on the old state-by-state basis.

That fragmented era ended on 22 August 2025, when Parliament passed the Promotion and Regulation of Online Gaming Act. The Act imposes a complete national ban on all online real-money games and, importantly, removes the skill-versus-chance distinction altogether - so casino games, betting, poker, rummy and fantasy sports for money are all prohibited alike. The ban is now in force, but it is being challenged before the Supreme Court of India on constitutional grounds, and that case is still pending.
