The Kahnawake Gaming Commission is one of the most reputed jurisdictions for licensing and regulating online gambling portals like online casinos and online poker rooms. The government does not agree with this thinking. According to them the constitution grants the tribes the rights to carry out activities integral to their original culture and this does not include gambling. The commission presently consists of three members appointed by the Mohawk Council of Kahnawake. These members have been empowered to license and regulate online gaming activity under its jurisdiction. The Kahnawake Gaming Commission charges an application fee of $15,000 from potential licensees. Once licensed the organizations have to pay an annual fee of $10,000. The licensees can display the Kahnawake logo on their web sites. Such is the power of this logo that it sets the minds of online players at rest and is instrumental in driving traffic to the licensee's gambling portal. The commission also accepts and investigates complaints against the licensees from online players.
Much of Kahnawake's reputation stems from the due diligence it exercises while scrutinizing initial applications. The application scrutiny evaluates three basic parameters: the background of the licensee, the fairness of the software and the ability of the licensee to pay the winners. In order to ensure that these objectives are met the information provided by the applicant is checked for veracity by an independent third party, the software is audited for fairness and the applicant's financial position is critically examined.
